The Series3 and TiVo HD support CableCARD.  Cable Labs controls the
specifications, regulations, and approvals surrounding CableCARD.  In
order to be allowed to support CableCARD TiVo has to meet their
requirements, which cover *all* areas of the device, even those not
directly related to the cards.  One of those areas is the movement of
content over network interfaces.  And this applies to the device as a
whole, even if the cards are not installed - approval is for the
*ability* to use the cards at all.

Technically TiVo probably could've enabled only uploading content to
the TiVo since CL is mainly concerned with moving cable content *from*
the receiving device.  But they were working with CableLabs on
approval for the whole system and did not want to confuse matters by
enabling half the feature, etc.  So they decided to wait and work with
CL to be able to fully enable all the network-related content movement
- TiVoToGo, TiVoToComeBack, and Multi-Room Viewing.

Cable Labs has approved standards for such things now, and TiVo has
said they they will have them enabled later this year.

It is just part of playing in the market and needing to not only meet
the specific licensing requirements, etc, but also being political and
not antagonizing a party you need to work with in order to fully
enable things.  It happens all the time in all industries, you just
have to walk the line.

Now TiVo is poised to bring the full feature set to the S3 and HD.
