The TC4 implementation of setLocale() is consistent with the 2.3 spec. The TC5 implementation of setLocale() is consistent with the 2.4 spec. The issue you identify is a valid one but the problem is with the spec, not with Tomcat's implementation of it - this is why it was clarified in 2.4. To maintain consistency between servlet containers tomcat has to implement the spec as written.
