Yes, it is a known issue for Tomcat 4.0.2 and 4.0.3. Putting the jars in $CATALINA_HOME/lib or $CATALINA_HOME/common/lib is the only workaround for these versions. To get the bugfix, you will need to upgrade to the nightly Tomcat 4.x or Tomcat 4.0.4-b1, or later.
