By "this" do you mean the data the collect? Data that's encrypted is not
collected. This is all mentioned in their current privacy policy, so I
definitely think it's relevant. The fact that they're part of the Facebook
group also affects how broadly they can use, and cross-reference, your
personal data, and this is also refered to explicitly in the terms.

Although it is very important it does not seem in scope with ToS;DR.
(Moreover your point about encrypted communications overlooks the fact
that, from what I have seen, Whatsapp keeps metadata logs, see

Let's not go into technical assessments unless it is directly linked to the
terms. For instance: does whatsapp undertake to only collect a minimal
information of data?
