Screen Brightness goes to 0 waking from sleep

Bug description:
Restarting, it remembers the screen brightness perfectly fine
opening the lid from sleep mode it starts at 0, and as soon as I hit one of
the Brightness buttons it seems to remember what it was set at. I don't wanna
have to hit the brightness every time I open my lid
