You can use "secure chats" in telegram, which provide end-to-end encryption (you can't use this feature with the normal telegram client for gnu-linux, but there are other, un-official free software clients that allow you to use it on your desktop as well), then you don't have to worry about the server software for the sake of privacy. Please also remember that it doesn't really matter if the server software is free or not unless you want to setup your own server. If you use the server of some other guy, you give away the control over your data anyway, because he has control over the server (no matter if he claims to run this piece of free software on it or not).

Besides, telegram is awesome from a practicle point of view. It's far superior to whatsapp and i don't understand why everyone would still stick to the latter one.
