As I understand it, the only issue would be if we distribute LPGL
software under the ASF licensing. What if we don't distribute CxxTest
with Tuscany, but rather request that users download it if they want to
run the tests?

I'd recommend checking if there are any issues with it's licensing, a
quick look at CxxTest website [1] mention that it's available under
LGPL, and that's not ASF friendly.
