the argument that the design of the track is not at fault is invalid. that would be like designing a car with a blade at the top of the windshield and saying it is safe unless you are in an accident. those tracks can be supported with bracing from below just as roller coasters are, which absorb far greater forces than a luge track. did the sledder make mistakes? probably and likely. should he have to pay with his life because his mistake ran him into an object that didn't need to be there? nope
