According to a friend of mine, the courts are considered non-essential, but
they are free to spend the money they have on hand from fines and
forfeitures without a Congressional appropriation and that's enough to get
them through at least a short shutdown. By the end of next week, if it goes
on that long, the only thing they'll be able to handle is cases where time
is of the essence.
