I don't think this is a super-hard problem. We have resolved much more tricky ones, so don't despair! I suggest you send the driver (but disabled) with a comment indicating where the problem is. We can get it applied and then we can discuss separately what new infrastructure is needed to resolve this. It has come up on several threads and I have a few ideas on what we could do.
