Ok, to follow on from above.

I can confirm I definatly had this problem, and everything was a above
(kernel version, ubunutu 8.10,  dmraid version etc etc...), however,
after a reboot of the system this problem disappeared.

If anyone out there cares I'll list the procedure I followed so if there
is a problem it can be fixed or (as I suspect) rather than fixing what
seems to be a strange (and probably user generated) issue anyone else
finding this can do what I have done.. ok......

1)  Installed Ubunutu
2)  Found howto get Linux to to reconise Intel ICH8R fakeRAID 5 array. I resent 
the fake bit btw, I'm very happy with my raid 5 array, looks natural to me ;) 
3)  Installed dmraid via sudo apt-get install dmraid
4)  dmraid -ay  {failed}
5)  reboot
6)  dmraid -ay {failed}
7)  re-installed dmraid and associated packages via synaptic
8)  dmraid -ay {failed}
9)  Trolled the interent for a few hours looking for issue
10)  reboot
11)  dmraid -ay {success!} 

Pretty sure I didn't do anything wrong, and definatly got that error
after installing dmraid via apt-get.  But there you go.....
