Fixed in ubiquity 1.13.5 by virtue of incorporating grub-installer 1.38ubuntu1. However, this isn't going to make today's automatic daily CD builds. So, to get this, look for a daily build TOMORROW, i.e. one dated 20090627 or later. You can find daily builds here:
http://cdimage.ubuntu.com/ubuntu-netbook-remix/daily-live/ Make sure that the .manifest file in the directory listing has a current date before you bother downloading anything; in the case of current builds you can see that it's dated 15 June, which means that a part of the build has been failing since then and it's just using old bits.
