I believe this may have something to do with the way alsa and pulse work 
together or the way pulse amplification works with alsa. I previous builds when 
pulse removed sound did not have the same issue.
This is still existent even w/ new sound card and proper driver.
In 9.10 though if pulse is removed the gnome-volume control will not work.
