This looks to be the same problem as bug #121900 I would say it is a bug, and that it is incorect for the system to enforce the mandatory access control. The user has physical posseson of the USB drive, and even if he does not have root on the current ubuntu system, he could easily put it in another system that he does have root on, such as a live CD.
