I think the behaviour is correct as designed - the app name is being displayed in the panel when windows are not maximised, and the window title is being displayed on the window itself. The menu in the panel is the menu for the window that has the focus.
I think this approach will definitely require some tweaking in the individual applications, though, and Empathy might be one of them.
