I've reproduced the issue with the mainline 2.6.38 kernel (2.6.38-020638rc2-generic #201101220905).
Instead SO FAR I've NEVER BEEN ABLE to reproduce it using the live distribution of Ubuntu 11.04 alpha (after rebooting about a dozen of times).
