Hi, I have the same problem on 2 machines both natty amd64 with open- source radeon driver (hd3200 and hd3300).
Sometimes the panel works as expected and sometimes suddenly it stays on top an never hides anymore until I restart gdm. See screenshot. I don't know when and why this happens.
