Same happens for me with my external USB 3.0 enclosure with kernel 3.0.0-12 in Oneiric. If i boot the PC with the enclosure attached and on it is used by xhci as USB 3.0. After switching it off and on again or after pulling the USB in and out is it only detected as a USB 2.0 device. The same procedure works under Win 7 without Problems, so it must be a software issue.
