I tested with the latest mainline build v3.2-rc7. The bug still exists
and was reproducible 5/5 shutdowns. On the 5th restart the disk checker
started up showing an error in '/' and had to be fixed before being able
to boot into the system.

I have also removed the tag 'needs-upstream-testing' and added 'kernel-
bug-exists-upstream' and changed status to 'Confirmed'

As a side note after the error in '/' was fixed the system time
defaulted and windows 7 on first boot was unstable and needed a couple
of reboots to be stable.
