I see 2b7b431858c284b62c18baaf2cea571be2797d5a as the most recent needed patch
for Tx checksum offloading in mainline.  It is needed for for 8168c and later 
chipsets. So
you could use 2.6.40 and beyond. However, as there has been a timespan of
regression after 92fc43b4159b518f5baae57301f26d770b0834c9 and Rx Fifo overflows
have only been recently fixed for some specific 8168c (see 
c7c2c39be8ed4e503e987151f4599455060e219a), I'd rather suggest using 3.2.

While not perfect, the r8169 outputs a 'XID' line in the kernel dmesg that 
should be
considered a must to identify the specific sub-chipset version in bug reports. 
lspci
is not specific enough.
