I see your point, hmmm..  the issue is when you open preferences from
the unity launcher with a right click, it is actually running "empathy
-p" which runs empathy and raises the preferences dialog.  Then you
close the contact list window, activating empathy again to raise it
seems to use the "-p" argument that was passed to empathy previously.
It looks like empathy is remembering the state, i have reproduced this
just by running it from a terminal.

1) without empathy running, run "empathy" in a terminal
2) close the contact list window
3) in another terminal, run "empathy -p", this will raise the contact list and 
open a preferences window
4) close the contact list and preferences windows again
5) run "empathy" in a terminal, this will raise the contact list and open the 
preferences window

So this rules out unity, compiz, or the messaging menu.
