I see your point, hmmm.. the issue is when you open preferences from the unity launcher with a right click, it is actually running "empathy -p" which runs empathy and raises the preferences dialog. Then you close the contact list window, activating empathy again to raise it seems to use the "-p" argument that was passed to empathy previously. It looks like empathy is remembering the state, i have reproduced this just by running it from a terminal.
