Gary, so you did the test in the "/sys/class/backlight/acpi_video0/" directory? If that's the case, that means the acpi driver works for you, you don't need any patch for the kernel.
Did you add any parameter to the kernel command line? "cat /proc/cmdline" and paste the result.
