The patch noted to resolve the upstream bug
https://bugzilla.kernel.org/show_bug.cgi?id=45071 was included in the
upstream stable v3.5.5 release. The Quantal 12.10 kernel has since been
rebased to the upstream v3.5.5 kernel and thus this patch has therefore
been included in the 12.10 Quantal kernel as of 3.5.0-17.26:
