I was able to reproduce the bug in another machine (this one has an Intel graphics card). I wasn't able to test 3.8.0-030800rc4-generic in the original machine from which I filled the bug report because it had some regression related to the nouveau driver.
Using 3.5.0-22-generic I was unable to umount the home partition, but using 3.8.0-030800rc4-generic from [0], everything went fine. So I'm marking 'kernel-fixed-upstream' as requested.
