Public bug reported:

Continues to fail, now in 3.8.0-5 kernel header update.  I cannot use
the manufacturers driver anymore (8.035.00) -- it does not work either.
This bug is preventing me from updating from 3.8.0-0 kernel.  It appears
that the reasons for failure are the same as it was for 3.8.0-1, etc.
