The kernel freeze is October 4th. There is still time to move the new kernel into Gutsy.
The fact that Mark Shuttleworth showed up in this forum to comment probably means that this will get fixed. I understand that when he feels strongly about something, it gets done, and that is the mark of a good CEO. If that ends up to be the case, I will likely offer to do some editing of documentation for Ubuntu.
