I deleted the alx driver version included with Ubuntu linux- image-3.8.0-11-generic: package and manually built the driver from the latest linux-next compat-drivers archive from http://linuxwireless.org/en/users/Download/stable/ (https://www.kernel.org/pub/linux/kernel/projects/backports/2013/03/04 /compat-drivers-2013-03-04-u.tar.bz2). It works. So I think the driver included with the Ubuntu kernel needs to be updated to the latest compat-wireless version.
