Public bug reported:

The newly generated file /boot/grub/grub.cfg is missing lines 90,91,92
compared to the livecd or postinstallation file.

Fresh installation of Ubuntu 13.04 /boot/grub/grub.cfg contains these lines 
(87-93):
### BEGIN /etc/grub.d/05_debian_theme ###
set menu_color_normal=white/black
set menu_color_highlight=black/light-gray
if background_color 44,0,30; then
  clear
fi
### END /etc/grub.d/05_debian_theme ###


When I use update-grub the whole if function is missing resulting in a 
monochromatic grub theme instead of the default background color:
### BEGIN /etc/grub.d/05_debian_theme ###
set menu_color_normal=white/black
set menu_color_highlight=black/light-gray
### END /etc/grub.d/05_debian_theme ###
