I was asked to test the latest kernel.  I installed this:

3.9.0-999-generic (#201304090434 SMP Tue Apr 9 08:36:01 UTC 2013)

I was asked to add a tag "kernel-bug-exists-upstream".  I don't know how
to "add a tag".  The problem with the "firmware bug" persists following
the switch to 3.9.0
