I tried to install the 3.9 kernel several times without success. Running the dpkg ended up in an error. I however tried to boot to the new kernel that was displayed in the boot options, but it failed to boot:
"kernel panic - not syncing: no init found. Try passing init=options to kernel" Meanwhile Ubuntu updated to 3.2.0-41 version. That didn't solve my issue. I can test some more if needed.
