Fixed refind (broke Windows 8 but that is another issue ;-)

Disabled fallback to legacy in the bios.
Booted from boot repair booting disk.
Issue related to the EFI partition being ntfs. Removed and re-added the 
partition as fat 32. Went to advanced in the boot repair program and set the 
boot partition to be different to the Ubuntu partition (new EFI partition). 
Repaired the boot and the system now correctly starts in UEFI mode. This also 
fixes the refind issue.

I would now consider the defect as fixed.
