sadly it turns out im not allowed to have another OS since its a work pc
so i found a way to get around it since ubuntu doesen't want to fix it

Boot live session > open "kde partition manager"
format the drive/s you wish to use and leave them unformatted
you can now add the partitions in the installer and the drive/s are already 
formatted

by default it will check the box to format when you add the new
partition which does not cause a problem/crash.
