I would agree that this should be considered for a Gutsy SRU.
https://wiki.ubuntu.com/KernelUpdates list a non-booting system as
critical bug fix that is permitted: "... These are bugs that keep users
from reliably using their systems, or prevent booting at all. ...".

Or, are there possible negative implications of this change that I don't
see?
