It it not an dist-upgrade is a simple upgrade. I consider this one a metabug - because is present since Ubuntu 6 ( then I saw him first time ).
Now it's here in Hardy. And it's a showstopper bug. A non geek can not deal with. And stop. That's why I consider this one as a META bug. Also is not a specific for a specific software package - I meet this bug on a lot of upgrades - here is about how Update Manager can deal with a duplicate file which try to overwrite an existing file.
