IMO including ZFS other way than using FUSE is not legal.
ZFS is licences under a licence incompatible with GPL-2 that is linux kernel
licenced under.
Therefore until Sun changes license or kernel will be released under GPL-3
(both cases are not seen in near future) there would be no legal way to
including ZFS in the kernel.
