Well a few days ago I installed hardy on my laptop with dist-upgrade, that did not solve the issue. (could still not switch consoles) Now this was not a fresh install, but it has the new xserver-xorg installed. So for me xserver-xorg-video-intel is not working in gutsy now.
On my desktop I am running gutsy with the xserver-xorg-video-intel_2.1.1-0ubuntu9.2~bwh1_i386.deb and that is working fine.
