I realized why this happens now. When the html file is local, the local mime properties determines which application opens the file. So if select an .html file in nautilus, select preferences->Open_with, then select epiphany, then fie:/// urls are then opened by epiphany.
This make sense -- it seems deskbar is doing the right thing using mime to select the application to open for a local file.
