So far it appears to be working with the 3.9rc7 mainline kernel without needing the workaround, or at least is taking much longer to trigger the issue. Howevre that kernel is not slated to go into 13.04 so this bug or one of its duplicates probably should be open still instead of 'Fix Released'. I am willing to test out any kernels to help get this issue fixed in 13.04.
