Mmm, ok, this can only happen when the ioctl handler is hung_up_tty_ioctl, i.e. the tty got hung up after Xorg opened it, most probably because with the parallel start in upstart the console may get tinkered with after Xorg gets started. After an Xorg restart (or equivalently, login/logout), no problem since no hung-up.
