It seems that the problem was introduced between rc8 and rc9 (see http://kernel.ubuntu.com/~kernel-ppa/info/kernel-version-map.html). Could you maybe check the mainline kernel builds from http://kernel.ubuntu.com/~kernel-ppa/mainline/ and verify that v2.6.31-rc8 does not tear, while v2.6.31-rc9 does. That would give us a definite set of changes in the mainline kernel that they may look at upstream.
