Paul and I were able to fix this; the files are attached to here:

If you got a moment to review; I am however pretty confident in the result (as 
we wrote a test case and spent a bit of time in the debugger). I am going to 
apply locally and try the uDig 1.2.3 release again; we have a lot of pull 
requests piling up (including one for WMS that is required for master to 
compile).
