Thanks Paul that is nice and clear: 

I had one adjustment to the wireframe (not that important in the grand scheme 
of things). Two top level radio buttons (and under each is the checkboxes that 
apply to that layer.

The checkboxes represent tool categories (so info indicates that the layer 
works with the info tool, select indicates it works with the selection tools, 
etc...). 

The idea being to make it obvious that background layers do not take part in 
the select tool, info tools, edit tool.

( * ) Layer
   [x] visible   

   [x] select
   [x] selectable
   [x] info
(   ) Background Layer
   [  ] visible   
   [  ] boundary

Now that I write that down I don't like the duplication on [ ] visible

OPTION LAYER TYPE RADIO BUTTONS

Take the Radio buttons up to the top and define layer type (and gray out the 
tools that don't apply to the background layer)

Type:  ( * ) Layer (  ) background

Render:
   [x] visible   


Tools:
   [x] select

   [x] selectable
   [x] info
   [x] boundary

OPTION RENDER / TOOL SEPARATION

Render:

   [x] visible   

Tools:

( * ) Layer
   [x] select

   [x] selectable
   [x] info
(   ) Background Layer
   [  ] boundary


We can ask the email list; or you can experiment to see which one of those 
options you prefer.
