Thanks Paul that is nice and clear: I had one adjustment to the wireframe (not that important in the grand scheme of things). Two top level radio buttons (and under each is the checkboxes that apply to that layer.
The checkboxes represent tool categories (so info indicates that the layer works with the info tool, select indicates it works with the selection tools, etc...). The idea being to make it obvious that background layers do not take part in the select tool, info tools, edit tool.
