Correct, current licensing schemes for AnyConnect will always activate up to 
the max the box is capable of. Sounds like you have a 5510 or 5512. 

If you have APEX or Plus licensing the license isn't locked to a single ASA, if 
you have multiple devices you can apply it to all of your firewalls as the 
licenses you purchase are based on the number of users who will use the VPN.  
Cisco haven't yet figured out how to sort out the ASA code to take account of 
their confusing VPN client licensing.   Naturally, they don't advertise this 
too widely, but it is rather handy at times like this.
