   Why would the car owner's insurer not pay to repair the car? Stupidity is
   not grounds for a denial of a property damage claim.  For example, if you
   are driving too fast for the conditions, lost control of your car, and hit a
   tree, the insurer  will still pay to fix the car notwithstanding the fact
   that the accident was your own fault.
   
My guess is that one can claim that they didn't intend to lose control
of the car, or that they didn't intend to drive too fast.  It's hard
to claim that you accidentally parallel parked next to a hydrant,
without intending to.
