This is not the desired behavior. It presents a usability problem (window title bar text and icon are partially obscured). See Bug 184551, and in particular, take a look at the screenshot.jpg presented by nxsty. Having the panel at the "same level" of windows is the intuitive, more usable, and more aesthetically pleasing arrangement.
