Good point, but even though the mode continues to return 1, the stack has the *appearance* of a palette, so again, it seems unlikely that this is what is going on. (Of course, if you use a custom windowshape for the system window, then there's no way to tell what kind of window it is, except for the fact that it remains layered above *all* windows.)
