I am not sure if I'm understanding it correctly what you are trying to achieve 
with the test-de site (pretending to be /de/test/path.html?)
You could instead create a redirecting page on top called "de" and map your 
current German site definition (with only 1 language and i18n disabled) to 
this. This would ensure that "/de" is not interpreted as part of a localized 
URL. However, since I'm not sure which version of Magnolia you're using, you 
might also be stumbling upon http://jira.magnolia-cms.com/browse/MGNLEE-200
