It's been fixed at one time (and duplicate names are not allowed), and I 'unfixed' it because something (probably oldadmin) relied on the ability to create 'empty articles'. So we either depracate the feature, or document it. I don't think Asgard or NAdmin use it. I still use oldadmin for some things, though. In any case, the sample code should not encourage it.
