Yes Dan, You are right. I miss-understood the WS-I spec. JaxWS2.0 makes it more clear and the implementation is perfect.
JAX-WS 2.0 "Conformance (Null Values in rpc/literal): If a null value is passed as an argument to a method, or returned from a method, that uses the rpc/literal style, then an implementation MUST throw a WebServiceException."
