I had the same issue with a vector layer and the WFS protocol. I created a ticket for that http://trac.openlayers.org/ticket/2177 and attached a path and a uuid generator class to this ticket. For instance - a random number as an argument to the server-side KML generator. A different way might be calling layer.refresh({force: true}); - but this might cause your page to do the query twice.
